Vynova Terms of Service

 

Effective Date: July 1, 2025 or the date you publish it

Welcome to Vynova! These Terms of Service ("Terms") govern your access to and use of the Vynova website, located at vynova.com.au (the "Site"), and any purchases you make through the Site. By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our Site or make any purchases.

 

1. Agreement to Terms

 

These Terms constitute a legally binding agreement between you ("User," "Customer," "you") and Vynova ("Vynova," "we," "us," "our"). These Terms apply to all users of the Site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

 

2. Intellectual Property

 

All content on this Site, including but not limited to the Vynova name, logo, text, graphics, product images, videos, audio, and software, is the property of Vynova or its content suppliers and is protected by Australian and international copyright, trademark, and other intellectual property laws.

You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site, use of the Service, or access to the Service or any content on the Site without express written permission from us. The Vynova 5-in-1 Hair Styler design and associated branding are proprietary; reverse engineering, unauthorized reproduction, or copying of our product is strictly prohibited.

 

3. User Conduct

 

By using our Site, you agree not to:

  • Use the Site for any unlawful purpose or in any way that violates applicable federal, state, local, or international laws or regulations.

  • Engage in any activity that interferes with or disrupts the Site or the servers and networks connected to the Site.

  • Transmit any harmful or malicious code, viruses, worms, or other destructive programs.

  • Collect or store personal data about other users without their express consent.

  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

  • Post or transmit any material that is offensive, defamatory, obscene, or otherwise objectionable.

  • Attempt to reverse engineer, decompile, or disassemble any part of the Site or our product.

 

4. Account Creation

 

You may have the option to create a customer account on our Site. If you choose to do so, you are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. We reserve the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, not current, or incomplete.

 

5. Product Information, Pricing, and Availability

 

Vynova strives to ensure that all product descriptions, images, and pricing displayed on the Site are accurate and up-to-date. However:

  • Accuracy: We do not warrant that product descriptions, images, pricing, or other content on the Site are error-free, complete, or current. While we are very accurate, errors may occasionally occur.

  • Colour/Appearance Variation: We have made every effort to display the colours and images of our product as accurately as possible. However, we cannot guarantee that your device’s display of any colour or appearance will be entirely accurate.

  • Right to Correct/Change: We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information (including product information, pricing, and availability) at any time without prior notice.

  • Order Acceptance: The display of products on our Site does not constitute an offer to sell. It is an invitation to treat. We reserve the right to refuse or cancel any order for any reason, including but not limited to product unavailability, errors in pricing or product description, or suspicion of fraudulent activity. If we cancel an order after you have been charged, we will issue a full refund to your original payment method.

 

6. Payment Terms

 

  • We accept payments via Credit Card, Debit Card, and Afterpay.

  • Payment for your order is due in full at the time of checkout. Your order will not be processed until full payment is received and confirmed.

 

7. Limitation of Liability

 

To the maximum extent permitted by law, Vynova, its directors, employees, agents, and affiliates, shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site; (ii) any conduct or content of any third party on the Site; (iii) any content obtained from the Site; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.


 

 

8. Disclaimer of Warranties

 

Except for the express 1-year (12-month) product warranty provided with the Vynova 5-in-1 Hair Styler as outlined in our Return & Refund Policy, the Site and all content, products, and services provided through the Site are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Vynova does not warrant that: (a) the Site will operate uninterrupted, securely, or be available at any particular time or location; (b) any errors or defects will be corrected; (c) the Site is free of viruses or other harmful components; or (d) the results of using the Site will meet your requirements.


 

 

9. Indemnification

 

You agree to indemnify, defend, and hold harmless Vynova and its affiliates, officers, directors, employees, consultants, and agents from any and all third-party claims, liability, damages, and costs (including, but not limited to, legal fees) arising from your use of our Site, your purchase or use of our products, or your breach of these Terms of Service.

 

10. Governing Law & Dispute Resolution

 

  • Governing Law: These Terms shall be governed and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.

  • Dispute Resolution: In the event of any dispute or claim arising out of or relating to these Terms or your use of the Site/purchase of products, we encourage you to contact us first at vynova.au@gmail.com to seek an informal resolution. If a resolution cannot be reached informally, any legal action or proceeding related to the Site shall be brought exclusively in the courts located in New South Wales, Australia.

 

11. Changes to Terms

 

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will indicate the "Effective Date" at the top of these Terms. By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Site.

 

12. Termination

 

We may terminate or suspend your access to our Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Our Site may contain links to third-party websites or services that are not owned or controlled by Vynova. These backlinks are provided for your convenience. Vynova has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Vynova shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.
